Department Overview
Pact seeks a Rule of Law Advisor for a 2 year (plus 3 year option period) project: Facilitating Access to Justice in South Sudan. This project is funded by the United States Department of State Bureau of International Narcotics and Law Enforcement Affairs (INL). The project will improve access to justice so that rural and marginalized citizens can access justice services that provide legal remedies to their problems. This will be achieved through educational awareness activities, legal aid services, capacity building and guidance for sub-recipient civil society organizations (CSOs), law enforcement actors, and customary law actors, the development of a law and policy package on legal aid, and research. The project will also support implementation of the recent Agreement on the Resolution of the Conflict in the Republic of South Sudan (ARCSS) through capacity-building of legal institutions and actors.
Position Purpose
The Rule of Law Advisor is responsible for working with rule of law actors, such as police, prosecutors, and prison staff to increase their ability to carry out their core functions. These actors currently lack an understanding of how to process and defend accused persons in line with international human rights standards. In addition, the Rule of Law Advisor will ensure that justice providers, including customary law and statutory law systems are in line with international human rights standards.
Key Responsibilities
The Rule of Law Advisor will oversee activities including:
Activities to advise police and prison staff on appropriate use of force policies, pre-trial detention standards, unlawful detentions, and ethical handling of accused persons
Develop training curriculum and implementation plan for policy and prison staff to be adopted by South Sudan National Police Service (SSNPS) and Corrections leadership as part of a long term strategic capacity building plan.
Oversee program to improve professionalism and effectiveness of prosecutors
Strengthen dialog and communication between rule of law actors
Ensure local justice providers are in line with international human rights standards with respect to women and juveniles
Increase coordination between statutory and customary law systems
Mentor statutory and traditional judges on procedural, administrative and substantive aspects of law
Facilitate community meetings between citizens and rule of law actors to build trust and unify their vision for justice, safety and security in the community
Qualifications
Law degree or Master’s degree in law, legal aid, or other relevant field preferred. Bachelor’s degree required.
Minimum of 10 years of experience in legal services in developing countries.
Understanding of legal context of South Sudan preferred
Experience with rule of law actors in South Sudan (including prosecutors, police, paralegals, judges, etc.) preferred
Fluency in English required
